| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, further providing for retail theft. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Section 3929(b)(1.1) of Title 18 of the |
6 | Pennsylvania Consolidated Statutes is amended to read: |
7 | § 3929. Retail theft. |

9 | (b) Grading.-- |
10 | * * * |
11 | (1.1) Any person who is convicted under subsection (a) |
12 | of retail theft of motor fuel may, in addition to any other |
13 | penalty imposed, be sentenced as follows: |
14 | (i) For a first offense, to pay a fine of not less |
15 | than $100 nor more than $250 and to have the person's |
16 | operating privilege suspended for 30 days. |
17 | (ii) For a second offense, to pay a fine of not less |
18 | than $250 nor more than $500 and to have the person's |

1 | operating privilege suspended for 60 days. |
2 | (iii) For a third or subsequent offense, to pay a |
3 | fine of not less than $500[, or the court may order the] |
4 | and to have the person's operating privilege [of the |
5 | person] suspended [for 30 days] for one year. A copy of |
6 | the order shall be transmitted to the Department of |
7 | Transportation. |
