| AN ACT |
| |
1 | Amending the act of April 9, 1929 (P.L.177, No.175), entitled |
2 | "An act providing for and reorganizing the conduct of the |
3 | executive and administrative work of the Commonwealth by the |
4 | Executive Department thereof and the administrative |
5 | departments, boards, commissions, and officers thereof, |
6 | including the boards of trustees of State Normal Schools, or |
7 | Teachers Colleges; abolishing, creating, reorganizing or |
8 | authorizing the reorganization of certain administrative |
9 | departments, boards, and commissions; defining the powers and |
10 | duties of the Governor and other executive and administrative |
11 | officers, and of the several administrative departments, |
12 | boards, commissions, and officers; fixing the salaries of the |
13 | Governor, Lieutenant Governor, and certain other executive |
14 | and administrative officers; providing for the appointment of |
15 | certain administrative officers, and of all deputies and |
16 | other assistants and employes in certain departments, boards, |
17 | and commissions; and prescribing the manner in which the |
18 | number and compensation of the deputies and all other |
19 | assistants and employes of certain departments, boards and |
20 | commissions shall be determined," in Department of Health, |
21 | providing for Alzheimer's disease programs. |
22 | The General Assembly of the Commonwealth of Pennsylvania |
23 | hereby enacts as follows: |
24 | Section 1. The act of April 9, 1929 (P.L.177, No.175), known |
25 | as The Administrative Code of 1929, is amended by adding a |
26 | section to read: |
27 | Section 2126. Alzheimer's Disease Programs.--(a) The |

1 | Department of Health shall have the power, and its duty shall |
2 | be: |
3 | (1) To develop a program to provide respite service programs |
4 | to persons suffering from Alzheimer's disease or related |
5 | disorders of aging. |
6 | (2) To administer the programs, contract with other public |
7 | or private organizations or make grants to provide services |
8 | under this section for respite and related services which may |
9 | include: |
10 | (i) diagnostic and evaluation programs; |
11 | (ii) day-care centers; |
12 | (iii) temporary care in nursing or boarding homes or other |
13 | institutions; or |
14 | (iv) in-home visiting or temporary nursing services. |
15 | (3) To develop rules and regulations to standardize the |
16 | necessary qualifications of respite service programs for |
17 | assistance, determine the eligibility of families or individuals |
18 | for assistance and develop a system of evaluation and review of |
19 | all programs. |
20 | (b) No grant, contract or other funding shall be allocated |
21 | or distributed until the Department of Health has received |
22 | verification of the existence of private funds committed to the |
23 | program or service for which the funds are to be allocated. No |
24 | allocation shall exceed the amount of private funding available. |
25 | (c) As used in this section, the term "respite service |
26 | program" means a program to assist individuals or families who |
27 | are providing primary care for an individual with Alzheimer's |
28 | disease or a related disorder of aging by providing temporary |
29 | care and assistance to the patient, individual or family. |
30 | Section 2. This act shall take effect in 60 days. |
