| AN ACT |

1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, further providing for |
3 | loss of property rights to the Commonwealth. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 6801(h) of Title 42 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 6801. Controlled substances forfeiture. |

10 | (h) Authorization to utilize property.--The district |
11 | attorney and the Attorney General shall utilize forfeited |
12 | property or proceeds thereof for the purpose of enforcing the |
13 | provisions of The Controlled Substance, Drug, Device and |
14 | Cosmetic Act[.], 18 Pa.C.S. (relating to crimes and offenses) |
15 | and 75 Pa.C.S. (relating to vehicles). In appropriate cases, the |
16 | district attorney and the Attorney General may designate |
17 | proceeds from forfeited property to be utilized by community- |
18 | based drug and crime-fighting programs and for relocation and |
