AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

Pennsylvania Consolidated Statutes, further providing for

3

loss of property rights to the Commonwealth.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 6801(h) of Title 42 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 6801.  Controlled substances forfeiture.

(h)  Authorization to utilize property.--The district

11

attorney and the Attorney General shall utilize forfeited

12

property or proceeds thereof for the purpose of enforcing the

13

provisions of The Controlled Substance, Drug, Device and

14

Cosmetic Act[.], 18 Pa.C.S. (relating to crimes and offenses)

15

and 75 Pa.C.S. (relating to vehicles). In appropriate cases, the

16

district attorney and the Attorney General may designate

17

proceeds from forfeited property to be utilized by community-

18

based drug and crime-fighting programs and for relocation and

protection of witnesses in criminal cases.

Section 2.  This act shall take effect in 60 days.
