AN ACT

Amending Title 4 (Amusements) of the Pennsylvania Consolidated

2

Statutes, providing for procedures and remedies upon default

3

of licensee.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1. Title 4 of the Pennsylvania Consolidated Statutes

7

is amended by adding a section to read:

8

§ 1332.  Procedures and remedies upon default of licensee.

9

(a)  Procedures.--The board shall establish procedures to be

10

used in the event a licensee has failed to fulfill any of the

11

conditions required by the board or provided for in this part.

12

(b)  Remedies.--The procedures shall specify the remedies

13

available to the board, which shall include:

14

(1)  Forfeiture of license fees or other fees.

15

(2)  Suspension of the license.

16

(3)  Submission of the defaulting license to trusteeship

17

of the board.

18

(4)  Revocation of the license.

(c)  Notice of default.--The board shall send a notice of

2

default to any licensed gaming entity, supplier, manufacturer,

3

gaming employee or other person that the board approves as

4

qualified to receive a license or a permit under this part

5

within 10 days of the failure of the entity to fulfill any of

6

the conditions required by the board or provided for in this

7

part. A copy of the notice shall also be sent to the Governor

8

and to the Community, Economic and Recreational Development

9

Committee of the Senate and the Gaming Oversight Committee of

10

the House of Representatives. The notice shall specify the

11

condition violated and provide a precise time period within

12

which the licensee may respond and correct the defaulting

13

condition before the board imposes any or all of the remedies

14

under subsection (b).

Section 2.  This act shall take effect in 60 days.
