| AN ACT |
| |
1 | Amending Title 53 (Municipalities Generally) of the Pennsylvania |
2 | Consolidated Statutes, in municipal authorities, further |
3 | providing for purposes and powers. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 5607(d) of Title 53 of the Pennsylvania |
7 | Consolidated Statutes is amended by adding a paragraph to read: |
8 | § 5607. Purposes and powers. |

10 | (d) Powers.--Every authority may exercise all powers |
11 | necessary or convenient for the carrying out of the purposes set |
12 | forth in this section, including, but without limiting the |
13 | generality of the foregoing, the following rights and powers: |

15 | (34) To operate as an aggregator or market aggregator, |
16 | as those terms are defined in 66 Pa.C.S. § 2803 (relating to |
17 | definitions), and to solicit bids from electricity suppliers |
18 | for the sole purpose of selling electricity to residents of |

1 | the municipality or municipalities that organized the |
2 | authority or to any municipality or school district located |
3 | wholly or partially within the boundaries of the municipality |
4 | or municipalities that organized the authority, provided that |
5 | the authority may not require residents to purchase |
6 | electricity from the authority. |

8 | Section 2. This act shall take effect in 60 days. |
