A BILL TO AMEND SECTION 56-1-385, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REINSTATEMENT OF A PERMANENTLY REVOKED DRIVER'S LICENSE, SO AS TO PROVIDE THAT CERTAIN PERSONS WHO HAVE HAD THEIR DRIVER'S LICENSES PERMANENTLY REVOKED AND WHO HAVE PETITIONED THE CIRCUIT COURT FOR REINSTATEMENT OF THEIR DRIVER'S LICENSES, MUST SERVE COPIES OF THE PETITION ON BOTH THE CIRCUIT SOLICITOR AND THE DIRECTOR OF THE DEPARTMENT OF MOTOR VEHICLES, TO PROVIDE THAT THE SOLICITOR AND THE DIRECTOR OF THE DEPARTMENT OF MOTOR VEHICLES, OR THEIR DESIGNEES, MAY RESPOND TO THE PETITION AND DEMAND A HEARING ON THE MERITS OF THE PETITION OR HAVE THE COURTS CONSIDER AFFIDAVITS SUBMITTED BY THE PETITIONER AND THE SOLICITOR, OR THE DIRECTOR OF THE DEPARTMENT OF MOTOR VEHICLES, OR THEIR DESIGNEES WHEN DETERMINING WHETHER CONDITIONS FOR DRIVING PRIVILEGE REINSTATEMENT HAVE BEEN MET BY THE PETITIONER, AND TO REVISE THE CONDITIONS UPON WHICH A DRIVER'S LICENSE MAY BE REINSTATED.

Provide That Certain Persons Who Have Had Their Driver's Licenses Permanently Revoked And Who Have Petitioned The Circuit Court For Reinstatement Of Their Driver's Licenses, Must Serve Copies Of The Petition On Both The Circuit Solicitor And The Director Of The Department Of Motor Vehicles, To Provide That The Solicitor And The Director Of The Department Of Motor Vehicles, Or Their Designees, May Respond To The Petition And Demand A Hearing On The Merits Of The Petition Or Have The Courts Consider Affidavits Submitted By The Petitioner And The Solicitor, Or The Director Of The Department Of Motor Vehicles, Or Their Designees When Determining Whether Conditions For Driving Privilege Reinstatement Have Been Met By The Petitioner, And To Revise The Conditions Upon Which A Driver's License May Be Reinstated.
