To who was referred a Bill (H.3934) to amend the South Carolina Code of Laws by amending Section 6-29-1625, relating to federal defense facilities definitions, so as to add Fort Gordon to the definition, etc., respectfully

Report:

That they have duly and carefully considered the same, and recommend that the same do pass with Amendment:

 

    Amend the bill, as and if amended, SECTION 1, by striking Section 6-29-1625(A) and inserting:

    (A) For purposes of this article, "federal military installations" includes Fort Jackson, Shaw Air Force Base, McEntire Air ForceJoint National Guard Base, Joint Base Charleston Air Force Base, Beaufort Marine Corps Air Station, Beaufort Naval Hospital, Parris Island Marine Recruit Depot, Fort Gordon, U.S. Coast Guard Sector Charleston, North Auxiliary Airfield, and Charleston Naval Weapons Station.

Renumber sections to conform.

Amend title to conform.

Explanation of Fiscal Impact

Local Expenditure

This bill adds Fort Gordon to the definition of federal military installations for the purposes of local government planning and development. Pursuant to Section 6-29-1620, a local government must take into consideration the needs of a local military installation when planning developments near the installation. While Fort Gordon is located in Augusta, Georgia, it is located close enough to Aiken County to potentially impact the county's local planning and development. RFA contacted Aiken County to determine the potential impact this bill may have for the county. Aiken County anticipates that any land use planning or regulations the county implements would not have any impact on Fort Gordon. Therefore, this bill will have no local expenditure impact.

TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY AMENDING SECTION 6-29-1625, RELATING TO FEDERAL DEFENSE FACILITIES DEFINITIONS, SO AS TO ADD FORT GORDON TO THE DEFINITION OF "FEDERAL MILITARY INSTALLATIONS".

 

Be it enacted by the General Assembly of the State of South Carolina:

 

SECTION 1.  Section 6-29-1625(A) of the S.C. Code is amended to read:

 

    (A) For purposes of this article, "federal military installations" includes Fort Jackson, Shaw Air Force Base, McEntire Air Force Base, Charleston Air Force Base, Beaufort Marine Corps Air Station, Beaufort Naval Hospital, Parris Island Marine Recruit Depot, Fort Gordon, and Charleston Naval Weapons Station.

 

SECTION 2.  This act takes effect upon approval by the Governor.
