A BILL TO BE ENTITLED
 
AN ACT
 
  relating to a common characteristic or use project in a public
  improvement district in certain municipalities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 372.0035(a), Local Government Code, is
  amended to read as follows:
         (a)  This section applies only to:
               (1)  a municipality that:
                     (A)  has a population of more than 650,000 and
  less than two million; [or]
                     (B)  has a population of more than 325,000 and
  less than 625,000; or
                     (C)  has a population of more than 180,000 and
  less than 200,000; and
               (2)  a public improvement district established under
  this subchapter and solely composed of territory in which the only
  businesses are:
                     (A)  hotels with 100 or more rooms ordinarily used
  for sleeping, if the district is established by a municipality
  described by Subdivision (1)(A); [or]
                     (B)  hotels with 75 or more rooms ordinarily used
  for sleeping, if the district is established by a municipality
  described by Subdivision (1)(B); or
                     (C)  hotels with 10 or more rooms ordinarily used
  for sleeping, if the district is established by a municipality
  described by Subdivision (1)(C).
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2019.
