BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 82, Family Code, is | ||
amended by adding Section 82.011 to read as follows: | ||
Sec. 82.011. DISMISSAL OR NONSUIT OF APPLICATION. An | ||
application for a protective order may not be dismissed and a | ||
nonsuit may not be taken unless the dismissal or nonsuit is approved | ||
by the court. The approval by the court of a dismissal or nonsuit of | ||
an application is without prejudice. | ||
SECTION 2. Section 82.011, Family Code, as added by this | ||
Act, applies to an application for a protective order that is | ||
pending in a trial court on the effective date of this Act or that is | ||
filed on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2015. |
