| transporting aggregates. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 621.101, Transportation Code, is amended | ||
| by adding Subsection (b-2) to read as follows: | ||
| (b-2) Notwithstanding Subsections (a)(1) and (2), a vehicle | ||
| or combination of vehicles that is transporting aggregates, as | ||
| defined by Section 28A.001, Water Code, over a highway or road of | ||
| this state may operate at an axle weight that is not heavier than | ||
| the weight equal to the maximum allowable axle weight provided by | ||
| those subdivisions plus a tolerance allowance of 15 percent of that | ||
| allowable weight, provided that the gross weight of the vehicle or | ||
| combination of vehicles is not heavier than the maximum gross | ||
| weight authorized for the roadway on which the vehicle or | ||
| combination of vehicles is being operated. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
