A BILL TO BE ENTITLED
 
AN ACT
  relating to axle weight limitations for certain vehicles
  transporting aggregates.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 621.101, Transportation Code, is amended
  by adding Subsection (b-2) to read as follows:
         (b-2)  Notwithstanding Subsections (a)(1) and (2), a vehicle
  or combination of vehicles that is transporting aggregates, as
  defined by Section 28A.001, Water Code, over a highway or road of
  this state may operate at an axle weight that is not heavier than
  the weight equal to the maximum allowable axle weight provided by
  those subsections plus a tolerance allowance of 15 percent of that
  allowable weight, provided that the gross weight of the vehicle or
  combination of vehicles is not heavier than 80,000 pounds.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
