relating to the assignment to a trial court of a judge or justice | ||
who was defeated in a primary or general election. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 74.053(d), Government Code, is amended | ||
to read as follows: | ||
(d) An assigned judge or justice who was defeated in the | ||
last primary or general election for which the judge or justice was | ||
a candidate for the judicial office held by the judge or justice may | ||
not sit in a criminal or civil case if either party objects to the | ||
judge or justice. | ||
SECTION 2. The change in law made by this Act applies only | ||
to the assignment of a judge or justice made on or after the | ||
effective date of this Act. An assignment made before the effective | ||
date of this Act is governed by the law in effect immediately before | ||
that date, and the former law is continued in effect for that | ||
purpose. | ||
SECTION 3. This Act takes effect September 1, 2015. |
