relating to an election to repeal a photographic traffic signal | ||
enforcement system ordinance. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 707, Transportation Code, is amended by | ||
adding Section 707.0022 to read as follows: | ||
Sec. 707.0022. ELECTION TO REPEAL ORDINANCE. (a) The | ||
governing body of a local authority shall submit to the voters of | ||
the local authority the question of repealing an ordinance adopted | ||
under Section 707.002 if the governing body receives a petition | ||
that requests the election and is signed by 10 percent of the | ||
registered voters of the local authority. | ||
(b) If a majority of the votes cast at the election favor the | ||
repeal of the ordinance, the governing body: | ||
(1) shall repeal the ordinance; and | ||
(2) may not subsequently adopt an ordinance under | ||
Section 707.002. | ||
(c) An election on the question of repealing an ordinance | ||
under Section 707.002 may not be held more often than every two | ||
years. | ||
SECTION 2. This Act takes effect September 1, 2015. |
