A BILL TO BE ENTITLED
 
AN ACT
  relating to the labeling of wine as originating from an area of this
  state.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 101, Alcoholic Beverage
  Code, is amended by adding Section 101.673 to read as follows:
         Sec. 101.673.  USE OF TEXAS APPELATION OF ORIGIN: AMERICAN
  VITICULTURAL AREA OR COUNTY. (a) In this section, "American
  viticultural area" has the meaning assigned by 27 C.F.R. Section
  4.25.
         (b)  A wine that is otherwise entitled to an appelation of
  origin indicating the wine's origin is an American viticultural
  area located in this state under federal law or a county within the
  boundaries of this state may use that appellation only if the wine
  is:
               (1)  100 percent by volume fermented juice of grapes or
  other fruit grown in this state, subject to the requirements of
  federal law, not less than 90 percent of which is derived from
  grapes grown within the boundaries of the labeled American
  viticultural area or county; and
               (2)  fully produced in this state.
         SECTION 2.  The change in law made by this Act applies only
  to a wine labeled on or after the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2021.
