relating to the obligation of a defendant to pay court-ordered | ||
restitution. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article 42.037, Code of Criminal Procedure, is | ||
amended by adding Subsection (h-1) to read as follows: | ||
(h-1) The duty to pay the restitution ordered under this | ||
article remains with the defendant until full restitution is paid, | ||
regardless of whether the defendant is serving a term of | ||
confinement or is under any form of state supervision. The amount of | ||
any unpaid restitution ordered under this article: | ||
(1) is subject to withdrawal from an inmate account in | ||
accordance with Section 501.014, Government Code, if the defendant | ||
is confined in a facility operated by or under contract with the | ||
Texas Department of Criminal Justice; and | ||
(2) may be collected as a condition of community | ||
supervision, parole, or mandatory supervision, if the defendant is | ||
under state supervision. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
