A BILL TO BE ENTITLED
AN ACT
relating to a reduction of amounts appropriated to the Texas
Department of Transportation for a violation of provisions relating
to public participation in the environmental review of
transportation projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 201.604, Transportation Code, is amended
by adding Subsection (f) to read as follows:
(f) If the department violates a requirement relating to
public participation in the environmental review of a
transportation project under this section or under rules adopted to
implement this section, the department is subject to a reduction of
amounts appropriated for administration by the General
Appropriations Act for the biennium following the biennium in which
the violation occurs in an amount not to exceed $100,000 for each
violation.
SECTION 2. This Act takes effect September 1, 2017.
