relating to the authority of certain tier 1 general-law | ||
municipalities to annex certain areas on petition by the area's | ||
property owners. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 43, Local Government Code, | ||
is amended by adding Section 43.0325 to read as follows: | ||
Sec. 43.0325. AUTHORITY OF CERTAIN MUNICIPALITIES TO ANNEX | ||
NONCONTIGUOUS AREA ON OWNER PETITION. (a) This section applies | ||
only to a municipality with a population of 1,780 to 1,800. | ||
(b) A municipality may annex an area that is noncontiguous | ||
to the boundaries of the municipality if: | ||
(1) the area's land development standards are more | ||
stringent than the land development standards in the municipality; | ||
and | ||
(2) the municipality receives a petition requesting | ||
the annexation that: | ||
(A) describes the area by metes and bounds; | ||
(B) is signed by each owner of real property in | ||
the area; and | ||
(C) is filed with the secretary of the | ||
municipality. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
