A BILL TO BE ENTITLED
 
AN ACT
  relating to intervention by the attorney general in a suit
  involving recognition of a same-sex marriage or civil union.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 6.204, Family Code, is amended by adding
  Subsection (d) to read as follows:
         (d)  The attorney general may intervene in a suit involving a
  right or claim asserted as a result of a marriage between persons of
  the same sex or a civil union at any time before the 90th day after
  the date a judgment is rendered in the suit.
         SECTION 2.  The change in law made by this Act applies to a
  suit that is pending in a trial court on the effective date of this
  Act or filed on or after that date.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
