relating to intervention by the attorney general in a suit | ||
involving recognition of a same-sex marriage or civil union. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 6.204, Family Code, is amended by adding | ||
Subsection (d) to read as follows: | ||
(d) The attorney general may intervene in a suit involving a | ||
right or claim asserted as a result of a marriage between persons of | ||
the same sex or a civil union at any time before the 90th day after | ||
the date a judgment is rendered in the suit. | ||
SECTION 2. The change in law made by this Act applies to a | ||
suit that is pending in a trial court on the effective date of this | ||
Act or filed on or after that date. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
