| relating to the confidentiality of certain information related to | ||
| the operation of certain municipally owned utilities. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 552.110, Government Code, is amended by | ||
| adding Subsection (c) to read as follows: | ||
| (c) This section does not apply to a contract between an | ||
| electric utility, as defined by Section 31.002, Utilities Code, and | ||
| a municipally owned utility, as defined by Section 11.003, | ||
| Utilities Code, that operates in a municipality that: | ||
| (1) has a population of less than 6,000; and | ||
| (2) is the county seat of a county that has a | ||
| population of less than 10,000. | ||
| SECTION 2. Section 552.133, Government Code, is amended by | ||
| adding Subsection (d) to read as follows: | ||
| (d) Notwithstanding any other part of this section, this | ||
| section does not apply to a contract between an electric utility, as | ||
| defined by Section 31.002, Utilities Code, and a municipally owned | ||
| utility, as defined by Section 11.003, Utilities Code, that | ||
| operates in a municipality that: | ||
| (1) has a population of less than 6,000; and | ||
| (2) is the county seat of a county that has a | ||
| population of less than 10,000. | ||
| SECTION 3. The change in law made by this Act applies only | ||
| to a request for public information made on or after the effective | ||
| date of this Act. A request for public information made before the | ||
| effective date of this Act is governed by the law in effect on the | ||
| date of the request, and the former law is continued in effect for | ||
| that purpose. | ||
| SECTION 4. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
