relating to the confidentiality of certain information related to | ||
the operation of certain municipally owned utilities. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 552.110, Government Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) This section does not apply to a contract between an | ||
electric utility, as defined by Section 31.002, Utilities Code, and | ||
a municipally owned utility, as defined by Section 11.003, | ||
Utilities Code, that operates in a municipality that: | ||
(1) has a population of less than 6,000; and | ||
(2) is the county seat of a county that has a | ||
population of less than 10,000. | ||
SECTION 2. Section 552.133, Government Code, is amended by | ||
adding Subsection (d) to read as follows: | ||
(d) Notwithstanding any other part of this section, this | ||
section does not apply to a contract between an electric utility, as | ||
defined by Section 31.002, Utilities Code, and a municipally owned | ||
utility, as defined by Section 11.003, Utilities Code, that | ||
operates in a municipality that: | ||
(1) has a population of less than 6,000; and | ||
(2) is the county seat of a county that has a | ||
population of less than 10,000. | ||
SECTION 3. The change in law made by this Act applies only | ||
to a request for public information made on or after the effective | ||
date of this Act. A request for public information made before the | ||
effective date of this Act is governed by the law in effect on the | ||
date of the request, and the former law is continued in effect for | ||
that purpose. | ||
SECTION 4. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
