relating to the board of directors of a public utility agency. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 572.057, Local Government Code, is | ||
amended by amending Subsection (b) and adding Subsections (b-1) and | ||
(c-1) to read as follows: | ||
(b) Except as provided by Subsection (b-1), each [ |
||
director must be appointed by place by the governing bodies of the | ||
participating public entities. Each participating public entity is | ||
entitled to appoint at least one director. | ||
(b-1) If a public utility agency has a service area that | ||
includes the unincorporated area of a county that is outside the | ||
boundaries of the agency's participating public entities, the | ||
commissioners court of the county may appoint the same number of | ||
directors as the number appointed by the participating public | ||
entity with the largest population that is less than the population | ||
of the unincorporated area. | ||
(c-1) A director must be a customer of the public utility | ||
agency and reside within the area served by the agency. | ||
SECTION 2. Section 572.057(c-1), Local Government Code, as | ||
added by this Act, applies only to the term of a director that | ||
begins on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
