A BILL TO BE ENTITLED
 
AN ACT
  relating to prohibitions on the use of a wireless communication
  device while using certain motor vehicles.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 545.425(c), Transportation Code, is
  amended to read as follows:
         (c)  Unless the vehicle is stopped, an [An] operator may not
  use a wireless communication device while operating:
               (1)  a passenger bus; or
               (2)  a vehicle that is used to transport clients of the
  business or public entity that owns or leases the vehicle,
  including a vehicle owned or leased by:
                     (A)  an institution that holds a license issued
  under Chapter 242, Health and Safety Code;
                     (B)  a facility that holds a license issued under
  Chapter 246 or 247, Health and Safety Code; or
                     (C)  an entity that provides special
  transportation services to persons who are disabled or elderly
  [with a minor passenger on the bus unless the passenger bus is
  stopped].
         SECTION 2.  The change in law made by this Act applies only
  to an offense committed on or after the effective date of this Act.
  An offense committed before the effective date of this Act is
  subject to the law in effect on that date, and that law is continued
  in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2011.
