| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 233.003(c), Election Code, is amended to | ||
| read as follows: | ||
| (c) The costs of an election contest may not be assessed | ||
| against a contestee specified by this section. The costs of an | ||
| election may be assessed [ |

| SECTION 2. The changes in law made by this Act apply only to | ||
| an election ordered on or after September 1, 2017. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
