relating to the composition of the board of trustees of certain | ||
independent school districts. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 11, Education Code, is | ||
amended by adding Section 11.0521 to read as follows: | ||
Sec. 11.0521. INCREASE IN NUMBER OF SINGLE-MEMBER TRUSTEE | ||
DISTRICTS IN CERTAIN DISTRICTS REQUIRED. (a) This section applies | ||
only to an independent school district with a student enrollment of | ||
more than 200,000. | ||
(b) Notwithstanding Section 11.051(b), the board of | ||
trustees of an independent school district subject to this section | ||
shall by resolution increase the membership of the board to 17. The | ||
resolution shall order that the additional members are to be | ||
elected from single-member trustee districts. | ||
(c) The resolution shall redivide the district into 17 | ||
trustee districts in accordance with the requirements of Section | ||
11.052(f). | ||
(d) Except as provided by Subsection (e), positions on the | ||
board shall be filled at the first regular election of trustees that | ||
occurs after the adoption of the resolution. The trustees then | ||
elected: | ||
(1) shall draw lots for staggered terms as provided by | ||
Section 11.059; and | ||
(2) must comply with the residency requirements of | ||
Section 11.052(g). | ||
(e) The position of a trustee in office when the resolution | ||
is adopted shall be filled as the staggered terms of the trustees | ||
then in office expire. A person's eligibility to serve as a trustee | ||
is not affected by a boundary change made under Subsection (c) that: | ||
(1) removes the person's residence from the trustee | ||
district the person serves; and | ||
(2) takes effect during the term for which the person | ||
was elected or appointed. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
