relating to the consideration of adequate alternatives to resolve | ||
transmission constraints. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 39.155, Utilities Code, is amended by | ||
adding Subsection (e) to read as follows: | ||
(e) In evaluating strategies to resolve constraints | ||
identified in the report required by Subsection (b), the ERCOT | ||
independent system operator and the commission shall consider any | ||
proposed transmission alternatives that would enable existing or | ||
proposed generation resources located in this state but not | ||
connected to the ERCOT power region to provide power to the ERCOT | ||
grid. If such an alternative is proposed, the commission may not | ||
approve a transmission project to resolve a constraint identified | ||
in the report until the commission makes specific findings | ||
approving or rejecting the use of the proposed alternative to | ||
resolve the constraint. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
