A BILL TO BE ENTITLED
 
AN ACT
  relating to the consideration of adequate alternatives to resolve
  transmission constraints.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.155, Utilities Code, is amended by
  adding Subsection (e) to read as follows:
         (e)  In evaluating strategies to resolve constraints
  identified in the report required by Subsection (b), the ERCOT
  independent system operator and the commission shall consider any
  proposed transmission alternatives that would enable existing or
  proposed generation resources located in this state but not
  connected to the ERCOT power region to provide power to the ERCOT
  grid. If such an alternative is proposed, the commission may not
  approve a transmission project to resolve a constraint identified
  in the report until the commission makes specific findings
  approving or rejecting the use of the proposed alternative to
  resolve the constraint.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
