relating to authorizing parents of students enrolled at a | ||
low-performing public school campus to petition the commissioner of | ||
education for the appointment of a board of managers, alternative | ||
management, or closure of the campus. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 39A.112, Education Code, is amended by | ||
amending Subsection (b) and adding Subsections (b-1) and (b-2) to | ||
read as follows: | ||
(b) Notwithstanding Section 39A.101, if a campus has been | ||
assigned an unacceptable performance rating under Section 39.054 | ||
for two consecutive school years, a majority of the parents of the | ||
students enrolled at the campus may, at any time, submit a petition | ||
to the commissioner requesting that the commissioner order one of | ||
the following actions: | ||
(1) appointment of a board of managers to govern the | ||
school district as provided by Section 39A.202; | ||
(2) alternative management of the campus; or | ||
(3) closure of the campus [ |

(b-1) The commissioner shall consider the action requested | ||
in a parents' petition under Subsection (b) in determining whether | ||
to order the requested action or another permissible action under | ||
this subchapter, including ordering the campus to prepare or | ||
implement a campus turnaround plan. | ||
(b-2) A petition submitted under Subsection (b) must be in a | ||
form prescribed by the commissioner. | ||
SECTION 2. This Act applies beginning with the 2019-2020 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
