relating to the eligibility of tuition and fee exemptions for | ||
certain military personnel and their dependents; requiring a fiscal | ||
impact study. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 54.341(l), Education Code, is amended to | ||
read as follows: | ||
(l) To be eligible to receive an exemption under Subsection | ||
(k), the child must: | ||
(1) be a student who is classified as a resident under | ||
Subchapter B when the child enrolls in an institution of higher | ||
education; | ||
(2) have submitted the Free Application for Federal | ||
Student Aid (FAFSA) and applied for any student financial | ||
assistance for the which the child may be eligible; and | ||
SECTION 2. Section 54.341, Education Code, is amended by | ||
adding Subsection (m) to read as follows: | ||
(m) The value of an exemption to which a child is eligible | ||
under Subsection (k) is limited to the net difference between the | ||
tuition and fees to which the exemption applies and the total amount | ||
of other grants or scholarships awarded to the child. | ||
SECTION 3. The changes in law made by this Act apply | ||
beginning with tuition and fees for the 2013 fall semester. | ||
SECTION 4. Section 61.0906, Education Code is added as | ||
follows: | ||
Sec. 61.0906. REPORTS TO JOINT OVERSIGHT COMMITTEE. (a) | ||
Not later June 1, 2014, the board shall submit to the Joint | ||
Oversight Committee on Higher Education Governance, Excellence, | ||
and Transparency a written report detailing the fiscal impact of | ||
Section 54.341, Education Code on public institutions of higher | ||
education. | ||
(b) The report shall include a 25 year analysis of the | ||
prospective fiscal impact to public institutions of higher | ||
education. | ||
(b) This section expires August 31, 2015. | ||
SECTION 5. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect on the 91st day after the last day of the | ||
legislative session. |
