relating to the dissolution of a bail bond board by the | ||
commissioners court of certain counties. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 1704.052, Occupations Code, is amended | ||
to read as follows: | ||
Sec. 1704.052. DISCRETIONARY CREATION AND DISSOLUTION OF | ||
BOARD. (a) A board may be created in a county with a population of | ||
less than 110,000 if: | ||
(1) a majority of the persons who would serve as | ||
members of the board under Section 1704.053, or who would designate | ||
the persons who would serve as members of the board, determine to | ||
create a board; and | ||
(2) the commissioners court approves the creation of | ||
the board by a majority vote. | ||
(b) The commissioners court may dissolve a board created | ||
under this section if the commissioners court: | ||
(1) approves the dissolution of the board by a | ||
majority vote; and | ||
(2) adopts written procedures to wind up the board's | ||
operations. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
