A BILL TO BE ENTITLED
 
AN ACT
  relating to the collection of soil monitoring samples from land
  application units where sewage sludge or domestic septage is
  applied.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 361, Health and Safety
  Code, is amended by adding Section 361.1215 to read as follows:
         Sec. 361.1215.  SOIL MONITORING SAMPLE COLLECTION FOR LAND
  APPLICATION OF SEWAGE SLUDGE OR DOMESTIC SEPTAGE. (a) In this
  section:
               (1)  "Domestic septage" means liquid or solid material
  removed from a septic tank, cesspool, portable toilet, marine
  sanitation device, or similar treatment works that receives only
  domestic sewage. The term does not include:
                     (A)  liquid or solid material removed from a
  septic tank, cesspool, or similar treatment works that receives
  commercial wastewater or industrial wastewater; or
                     (B)  grease removed from a grease trap.
               (2)  "Land application unit" has the meaning assigned
  by Section 361.121(a).
         (b)  Soil monitoring samples required by the commission for a
  land application unit at which sewage sludge or domestic septage is
  applied must be collected by a commission inspector.
         SECTION 2.  This Act takes effect September 1, 2019.
