| store permit. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 22, Alcoholic Beverage Code, is amended | ||
| by adding Section 22.18 to read as follows: | ||
| Sec. 22.18. DISTANCE FROM OTHER PACKAGE STORES. Except as | ||
| provided by Section 109.59, on or after September 1, 2019, the | ||
| commission may not issue a permit under this chapter for a premises | ||
| that is located within 5000 feet of the premises of another package | ||
| store permittee. | ||
| SECTION 2. Section 109.59(a), Alcoholic Beverage Code, is | ||
| amended to read as follows: | ||
| (a) If at the time an original alcoholic beverage permit or | ||
| license is granted for a premises the premises satisfies the | ||
| requirements regarding distance from schools, churches, and other | ||
| types of premises established in this code, including Section | ||
| 22.18, | ||
| and any other law or ordinance of the state or a political | ||
| subdivision of the state in effect at that time, the premises shall | ||
| be deemed to satisfy the distance requirements for all subsequent | ||
| renewals of the license or permit. | ||
| SECTION 3. This Act takes effect September 1, 2019. | ||
