relating to certain employment and occupational licensing | ||
restrictions based on a person's prior conviction. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 22.092, Education Code, is amended by | ||
adding Subsection (c-1) to read as follows: | ||
(c-1) Notwithstanding any other law, a person is not | ||
ineligible for employment in a public school as a food service | ||
worker solely because the person has been convicted of a | ||
nonviolent, nonsexual offense. | ||
SECTION 2. Subchapter B, Chapter 53, Occupations Code, is | ||
amended by adding Section 53.027 to read as follows: | ||
Sec. 53.027. ELIGIBILITY FOR CERTAIN LICENSES. (a) This | ||
section applies only to a license issued under: | ||
(1) Title 3; | ||
(2) Title 7; | ||
(3) Title 8; or | ||
(4) Title 12. | ||
(b) Notwithstanding any other law, an applicant may not be | ||
denied a license to which this section applies based solely on the | ||
applicant having been convicted of a nonviolent, nonsexual offense. | ||
SECTION 3. Section 522.081, Transportation Code, is amended | ||
by adding Subsection (i) to read as follows: | ||
(i) Notwithstanding any other law, a person may not be | ||
disqualified from driving a commercial motor vehicle based solely | ||
on the person having been convicted of a nonviolent, nonsexual | ||
offense. | ||
SECTION 4. This Act takes effect September 1, 2021. |
