| relating to the distribution to school districts of certain excess | ||
| funds appropriated for the Foundation School Program. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter F, Chapter 48, Education Code, is | ||
| amended by adding Section 48.282 to read as follows: | ||
| Sec. 48.282. DISTRIBUTION OF EXCESS FUNDS. Notwithstanding | ||
| any other provision of law, not later than September 1 of any year | ||
| following a school year in which the commissioner determines that | ||
| the amount appropriated for purposes of the Foundation School | ||
| Program exceeded the amount to which school districts were entitled | ||
| under this chapter, the commissioner shall: | ||
| (1) notify the Legislative Budget Board of the excess | ||
| funds; and | ||
| (2) distribute the excess funds, less the amount | ||
| required to comply with Section 48.265, as determined by the | ||
| commissioner, to each school district in an equal amount per | ||
| student in weighted average daily attendance for the previous | ||
| school year. | ||
| SECTION 2. This Act takes effect September 1, 2023. | ||
