relating to a requirement that a state agency reveal the identity of | ||
certain anonymous complainants to the person against whom the state | ||
agency has initiated a contested case. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subtitle A, Title 10, Government Code, is | ||
amended by adding Chapter 2010 to read as follows: | ||
CHAPTER 2010. DISCLOSURE OF CERTAIN | ||
INFORMATION BY STATE AGENCIES | ||
Sec. 2010.001. DEFINITION. In this chapter, "state agency" | ||
means an officer, board, commission, department, or other agency in | ||
the executive branch of state government with statewide | ||
jurisdiction that makes rules or determines contested cases. | ||
Sec. 2010.002. IDENTITY OF COMPLAINANT. At the time a state | ||
agency initiates a contested case against a person under Chapter | ||
2001 in a proceeding that was initiated on the basis of an anonymous | ||
complaint, the state agency shall disclose to the person the | ||
identity of the complainant. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a complaint filed with a state agency on or after the effective | ||
date of this Act. A complaint filed with a state agency before the | ||
effective date of this Act is subject to the law in effect on the | ||
date the complaint is filed, and that law is continued in effect for | ||
that purpose. | ||
SECTION 3. This Act takes effect September 1, 2011. |
