| elderly persons. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 48, Human Resources Code, | ||
| is amended by adding Section 48.15215 to read as follows: | ||
| Sec. 48.15215. INVESTIGATIONS OF ALLEGED EXPLOITATION OF | ||
| CERTAIN ELDERLY PERSONS. (a) An investigation of alleged | ||
| exploitation of an elderly person may be continued by the adult | ||
| protective services division of the department or by an entity | ||
| authorized to conduct the investigation for up to two years | ||
| following the date of the elderly person's death. | ||
| (b) This section applies only to an investigation that | ||
| begins before an elderly person's death. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
