BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 43.0672, Local Government Code, is | ||
amended by amending Subsection (a) and adding Subsection (d) to | ||
read as follows: | ||
(a) Notwithstanding Section 212.172 or any contractual | ||
provision to the contrary and not earlier than the 90th day before | ||
the date of the annexation, the [ |

municipality that elects to annex an area under this subchapter | ||
must first negotiate and enter into a written agreement with the | ||
owners of land in the area for the provision of services in the | ||
area. | ||
(d) An agreement that authorizes a municipality to annex the | ||
land that is the subject of the agreement may not waive the | ||
requirements described by this section. | ||
SECTION 2. The changes in law made by this Act apply only to | ||
an annexation of an area that was not final on the effective date of | ||
this Act. An annexation that was final before the effective date of | ||
this Act is governed by the law applicable to the annexation | ||
immediately before the effective date of this Act, and that law is | ||
continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2025. |
