BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. The heading to Section 1067.059, Special | ||
District Local Laws Code, as effective April 1, 2011, is amended to | ||
read as follows: | ||

EMPLOYEES. | ||
SECTION 2. Section 1067.059, Special District Local Laws | ||
Code, as effective April 1, 2011, is amended by amending Subsection | ||
(b) and adding Subsections (b-1) and (d) to read as follows: | ||
(b) The board may employ physicians, technicians, nurses, | ||
other health care providers, and other employees as considered | ||
necessary for the efficient operation of the hospital. Except as | ||
provided by Subsection (b-1), the board [ |

district administrator has the authority to admit or employ those | ||
persons. | ||
(b-1) The board may not delegate to the district | ||
administrator the authority to employ physicians. | ||
(d) This section may not be construed as authorizing the | ||
board to supervise or control the practice of medicine, as | ||
prohibited by Subtitle B, Title 3, Occupations Code. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
