A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of the board of directors of the Muenster
  Hospital District to employ physicians and other health care
  providers.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Section 1067.059, Special
  District Local Laws Code, as effective April 1, 2011, is amended to
  read as follows:
         Sec. 1067.059.  [APPOINTMENT AND RECRUITMENT OF] STAFF AND
  EMPLOYEES.
         SECTION 2.  Section 1067.059, Special District Local Laws
  Code, as effective April 1, 2011, is amended by amending Subsection
  (b) and adding Subsections (b-1) and (d) to read as follows:
         (b)  The board may employ physicians, technicians, nurses,
  other health care providers, and other employees as considered
  necessary for the efficient operation of the hospital. Except as
  provided by Subsection (b-1), the board [or] may provide that the
  district administrator has the authority to admit or employ those
  persons.
         (b-1)  The board may not delegate to the district
  administrator the authority to employ physicians.
         (d)  This section may not be construed as authorizing the
  board to supervise or control the practice of medicine, as
  prohibited by Subtitle B, Title 3, Occupations Code.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
