| Commission of Texas for the ERCOT power region. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 39.159, Utilities Code, as added by | ||
| Chapter 426 (S.B. 3), Acts of the 87th Legislature, Regular | ||
| Session, 2021, is amended by adding Subsection (d) to read as | ||
| follows: | ||
| (d) The commission shall ensure that any commission program | ||
| adopted to comply with the requirements of this section that | ||
| assigns credits to or provides for capacity payments to generation | ||
| facilities includes credits or payments available to nuclear and | ||
| advanced nuclear generation facilities. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
