BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 324, Health and Safety | ||
Code, is amended by adding Section 324.1015 to read as follows: | ||
Sec. 324.1015. BILLING STATEMENT; CIVIL LIABILITY. (a) A | ||
facility's billing statement to a consumer must include: | ||
(1) an itemized list of each health care service | ||
provided to the consumer; | ||
(2) an itemized list of each health care supply | ||
provided to the consumer; and | ||
(3) a list of each physician or other health care | ||
practitioner licensed to provide health care in this state who | ||
provided a health care service to the consumer. | ||
(b) A consumer is not liable to a facility for any billed | ||
charge on a billing statement that violates this section. If a | ||
facility files a civil action against a consumer for a charge | ||
described by this subsection and the consumer prevails in the | ||
action, the consumer may recover reasonable attorney's fees and | ||
costs. | ||
SECTION 2. Section 324.1015, Health and Safety Code, as | ||
added by this Act, applies only to a health care service provided on | ||
or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2019. |
