| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter Z, Chapter 552, Local Government | ||
| Code, is amended by adding Section 552.9061 to read as follows: | ||
| Sec. 552.9061. PARTICIPATION IN WHOLESALE ELECTRIC MARKET. | ||
| Notwithstanding any other law, a municipally owned utility may not | ||
| sell electric energy at wholesale if the utility has, during the | ||
| preceding five municipal fiscal years, earned less revenue from | ||
| wholesale sales in the electricity market than the utility has | ||
| spent. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to a municipal fiscal year that begins on or after the effective | ||
| date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2023. | ||
