relating to medical examinations for certain children taken into | ||
possession by the Department of Family and Protective Services or | ||
another governmental entity. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 264, Family Code, is | ||
amended by adding Section 264.1076 to read as follows: | ||
Sec. 264.1076. MEDICAL EXAMINATION REQUIRED. (a) This | ||
section applies only to a child who has been taken into possession | ||
by the department or another governmental entity and remains in the | ||
custody of the department or entity for more than 30 days. | ||
(b) The department shall ensure that each child described by | ||
Subsection (a) is examined by a physician not later than the 30th | ||
day after the date the child is removed from the child's home. | ||
SECTION 2. Section 264.1076, Family Code, as added by this | ||
Act, applies only to a child who is taken into possession by the | ||
Department of Family and Protective Services or another | ||
governmental entity on or after the effective date of this Act. A | ||
child taken into possession by the Department of Family and | ||
Protective Services or another governmental entity before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the child was taken into possession, and the former law is | ||
continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2017. |
