| relating to the training for and use of electromagnetic pulse | ||
| devices by peace officers and reserve law enforcement officers. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter F, Chapter 1701, Occupations Code, is | ||
| amended by adding Section 1701.260 to read as follows: | ||
| Sec. 1701.260. ELECTROMAGNETIC PULSE DEVICES; TRAINING. | ||
| (a) In this section, "electromagnetic pulse device" means a | ||
| portable device designed to generate a high amplitude electric | ||
| field capable of disabling an electronic system without causing | ||
| permanent damage to the system. | ||
| (b) The commission by rule shall: | ||
| (1) designate an electromagnetic pulse device for use | ||
| in disabling a motor vehicle if the commission determines the | ||
| device is suitable for use by officers; and | ||
| (2) establish a voluntary training program for | ||
| officers licensed under this chapter that provides instruction in | ||
| the use of the electromagnetic pulse devices determined suitable by | ||
| the commission. | ||
| (c) The commission shall administer the electromagnetic | ||
| pulse device training program and shall issue a certificate of | ||
| proficiency to each officer the commission determines has | ||
| successfully completed the training program. | ||
| (d) The commission may establish reasonable and necessary | ||
| fees for the administration of this section. | ||
| SECTION 2. This Act takes effect September 1, 2013. | ||
