relating to an affirmative defense to the offense of operating a | ||
vehicle without displaying two license plates. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 504.943, Transportation Code, is amended | ||
by adding Subsection (d-1) to read as follows: | ||
(d-1) It is an affirmative defense to prosecution under | ||
Subsection (a) for failure to display a license plate at the front | ||
of a vehicle that the vehicle: | ||
(1) is equipped with driving sensors the functioning | ||
of which would be impaired by the display of a front license plate; | ||
or | ||
(2) was not equipped by the manufacturer with a | ||
mounting plate for a front license plate. | ||
SECTION 2. The change in law made by this Act applies only | ||
to an offense committed on or after the effective date of this Act. | ||
An offense committed before the effective date of this Act is | ||
covered by the law in effect on the date the offense was committed, | ||
and the former law is continued in effect for that purpose. For | ||
purposes of this section, an offense was committed before the | ||
effective date of this Act if any element of the offense occurred | ||
before that date. | ||
SECTION 3. This Act takes effect September 1, 2019. |
