| rescinding the 1899 application of the 26th Texas Legislature to | ||
| the United States Congress to call an unrestricted convention under | ||
| Article V of the United States Constitution. | ||
| WHEREAS, The 26th Texas Legislature applied to the United | ||
| States Congress 112 years ago to call a convention, pursuant to | ||
| Article V of the United States Constitution, to propose amendments | ||
| to that constitution; and | ||
| WHEREAS, That particular application did not provide any | ||
| limitation on the subject matter of amendments to be considered or | ||
| proposed by such a convention; and | ||
| WHEREAS, At the present time, the Texas Legislature has | ||
| absolutely no desire or intention whatsoever for Congress to call | ||
| an Article V convention of a general and unlimited nature; now, | ||
| therefore, be it | ||
| RESOLVED, That the 82nd Texas Legislature hereby rescinds the | ||
| application to Congress made by Senate Concurrent Resolution 4, | ||
| Acts of the 26th Legislature, Regular Session, 1899, pursuant to | ||
| Article V, for the calling of an open-ended convention to propose | ||
| federal constitutional amendments, as reprinted in the | ||
| Congressional Record of December 11, 1899, at page 219; and, be it | ||
| further | ||
| RESOLVED, That the Texas secretary of state forward official | ||
| copies of this resolution to the vice president of the United States | ||
| (in his capacity as presiding officer of the United States Senate), | ||
| to the speaker of the United States House of Representatives, and to | ||
| all members of the Texas delegation to Congress with the request | ||
| that this resolution be officially entered in the Congressional | ||
| Record as a rescission of the application to Congress of the 26th | ||
| Texas Legislature requesting an indeterminate constitutional | ||
| convention. | ||
