A JOINT RESOLUTION
proposing a constitutional amendment authorizing the denial of bail
to certain persons arrested for evading arrest or detention.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Article I, Texas Constitution, is amended by
adding Section 11d to read as follows:
Sec. 11d. A person taken into custody for the offense of
evading arrest or detention may be denied release on bail pending
trial if a judge or magistrate, following a hearing, determines by a
preponderance of the evidence that the person has been charged with
evading arrest at least two times within a thirty day period.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 2, 2021.
The ballot shall be printed to provide for voting for or against the
proposition: "The constitutional amendment authorizing the denial
of bail to persons arrested for evading arrest or detention."
