proposing a constitutional amendment authorizing the denial of bail | ||
to certain persons arrested for evading arrest or detention. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article I, Texas Constitution, is amended by | ||
adding Section 11d to read as follows: | ||
Sec. 11d. A person taken into custody for the offense of | ||
evading arrest or detention may be denied release on bail pending | ||
trial if a judge or magistrate, following a hearing, determines by a | ||
preponderance of the evidence that the person has been charged with | ||
evading arrest at least two times within a thirty day period. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 2, 2021. | ||
The ballot shall be printed to provide for voting for or against the | ||
proposition: "The constitutional amendment authorizing the denial | ||
of bail to persons arrested for evading arrest or detention." |
