relating to certain contracts requiring competitive bidding by the | ||
Texas Department of Transportation. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 223.001, Transportation Code, is amended | ||
to read as follows: | ||
Sec. 223.001. CONTRACT REQUIRING COMPETITIVE BIDS. | ||
(a) This section applies only to a highway that is part of the | ||
state highway system. | ||
(b) The department shall submit for competitive bids each | ||
contract for: | ||
(1) the improvement of a highway [ |
||
|
||
(2) materials to be used in the construction or | ||
maintenance of a [ |
||
(3) traffic control or safety devices to be used on a | ||
highway. | ||
SECTION 2. This Act applies only in relation to a contract | ||
for which the Texas Department of Transportation first advertises | ||
or otherwise solicits bids, proposals, offers, or qualifications on | ||
or after the effective date of this Act. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. | ||
