relating to the Texas State Board of Pharmacy. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 552.001(a), Occupations Code, is amended | ||
to read as follows: | ||
(a) The Texas State Board of Pharmacy consists of 11 [ |
||
members appointed by the governor with the advice and consent of the | ||
senate as follows: | ||
(1) six members who are pharmacists; [ |
||
(2) one member who is a pharmacy technician; and | ||
(3) four [ |
||
SECTION 2. Section 552.002, Occupations Code, is amended by | ||
adding Subsection (b-1) to read as follows: | ||
(b-1) A pharmacy technician board member must, at the time | ||
of appointment: | ||
(1) be a resident of this state; | ||
(2) have been registered as a pharmacy technician for | ||
the five years preceding appointment; | ||
(3) be in good standing to act as a pharmacy technician | ||
in this state; and | ||
(4) be acting as a pharmacy technician in this state. | ||
SECTION 3. Section 552.005(a), Occupations Code, is amended | ||
to read as follows: | ||
(a) Members of the board are appointed for staggered | ||
six-year terms, with either [ |

terms, as applicable, expiring [ |
||
midnight on the last day of the state fiscal year in the last year of | ||
the member's term. | ||
SECTION 4. Section 552.010(a), Occupations Code, is amended | ||
to read as follows: | ||
(a) The board shall meet at least[ |

SECTION 5. As soon as practicable after the effective date | ||
of this Act, the governor shall appoint a pharmacy technician and a | ||
public member to the Texas State Board of Pharmacy as required by | ||
this Act. In appointing the members, the governor shall appoint: | ||
(1) a pharmacy technician to a term expiring August | ||
31, 2017; and | ||
(2) a public member to a term expiring August 31, 2015. | ||
SECTION 6. This Act takes effect September 1, 2011. |
