BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article 45.0216(h), Code of Criminal Procedure, | ||
is amended to read as follows: | ||
(h) Records of a person under 17 years of age relating to a | ||
complaint [ |
||
be expunged under this article if the complaint was dismissed: | ||
(1) as provided by Article 45.051 or 45.052; or | ||
(2) under another provision of this code and: | ||
(A) the person was not convicted of any other | ||
offense arising out of the criminal episode, as defined by Section | ||
3.01, Penal Code, from which the complaint arose; and | ||
(B) any applicable statute of limitation that | ||
applies to any offense arising out of the criminal episode has | ||
expired. | ||
SECTION 2. The change in law made by this Act applies to | ||
arrest records and files created before, on, or after the effective | ||
date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2015. |
