disciplining a faculty member of a public institution of higher | ||
education in this state. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 51.942, Education Code, is amended by | ||
adding Subsection (c-1) to read as follows: | ||
(c-1) For purposes of Subsection (c)(5), good cause for | ||
revoking the tenure of or otherwise disciplining a faculty member | ||
includes the faculty member's initiation of a civil suit against a | ||
student enrolled at the institution, regardless of whether the | ||
claim is subsequently litigated or dismissed. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
