BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 3, Article 42.09, Code of Criminal | ||
Procedure, is amended to read as follows: | ||
Sec. 3. If a defendant [ |

sentenced to death or to [ |

for release on bail pending appeal under Article 44.04(b) and [ |
||
gives notice of appeal, the defendant [ |
||
the department on a commitment pending a mandate from the court of | ||
appeals or the Court of Criminal Appeals. | ||
SECTION 2. This Act takes effect September 1, 2015. |
