relating to reporting by the market monitor of potential | ||
manipulation of the wholesale electric market. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 39.1515, Utilities Code, is amended by | ||
amending Subsection (f) and adding Subsection (i) to read as | ||
follows: | ||
(f) The market monitor immediately shall report in writing | ||
directly to both the commission and commission staff all [ |
||
potential market manipulations and all [ |
||
potential violations of commission rules or rules of the | ||
independent organization. | ||
(i) On February 1 of each year, the commission shall provide | ||
a public report that describes for the previous 12 months: | ||
(1) the number of instances in which the market | ||
monitor reported potential market manipulation to the commission or | ||
commission staff; | ||
(2) the laws, regulations, and ERCOT requirements | ||
alleged to have been violated by the reported entities; and | ||
(3) the number of instances reported under Subdivision | ||
(1) for which the commission or commission staff initiated | ||
enforcement action. | ||
SECTION 2. This Act takes effect September 1, 2023. |
